Terms and Conditions for EirePeak Pathways
Welcome to EirePeak Pathways! These Terms and Conditions ("Terms") govern your access to and use of our online platform and participation in our outdoor adventure social programs, guided mountain hikes, wilderness therapy sessions, community building workshops, and educational nature experiences. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Acceptance of Terms
By registering for or participating in any program or activity offered by EirePeak Pathways, or by using our site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
2. Our Services
EirePeak Pathways provides a range of outdoor adventure social programs, including but not limited to guided mountain hikes, wilderness therapy, community building workshops, and educational nature experiences. These services are designed to promote community engagement, personal growth, and appreciation for nature.
3. User Responsibilities and Conduct
- Accuracy of Information: You agree to provide accurate, current, and complete information during registration and for all program bookings.
- Health and Fitness: You are responsible for ensuring your physical fitness and health are suitable for the chosen activity. You must disclose any medical conditions or allergies to EirePeak Pathways staff prior to participation.
- Adherence to Instructions: You agree to follow all instructions, safety guidelines, and rules provided by EirePeak Pathways guides and staff during activities.
- Respectful Conduct: Participants are expected to behave respectfully towards other participants, staff, the environment, and local communities. Any disruptive, abusive, or harmful behavior may result in immediate expulsion from programs without refund.
- Equipment: You are responsible for bringing appropriate personal equipment as specified for each program. EirePeak Pathways is not responsible for lost or damaged personal belongings.
4. Booking, Payment, and Cancellation
- Bookings: All program bookings are subject to availability and confirmation by EirePeak Pathways.
- Payment: Full payment is required at the time of booking unless otherwise stated. Payment methods will be specified on our site.
- Cancellations by Participant: Cancellation policies vary by program and will be clearly outlined during the booking process. Generally, cancellations made within a certain timeframe may incur a cancellation fee or result in forfeiture of a deposit.
- Cancellations by EirePeak Pathways: EirePeak Pathways reserves the right to cancel or reschedule programs due to unforeseen circumstances, including but not limited to severe weather, insufficient participant numbers, or guide unavailability. In such cases, participants will be offered an alternative date or a full refund.
5. Safety and Waivers
Outdoor adventure activities inherently involve risks. By participating in EirePeak Pathways programs, you acknowledge and accept these risks. Participants may be required to sign a liability waiver prior to engaging in certain activities. This waiver will detail the inherent risks and release EirePeak Pathways from liability for certain types of injury or loss.
6. Intellectual Property
All content on our online platform, including text, graphics, logos, images, and program materials, is the property of EirePeak Pathways or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission from EirePeak Pathways.
7. Limitation of Liability
To the fullest extent permitted by law, EirePeak Pathways, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on our service; (iii) any content obtained from our service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
8. Indemnification
You agree to defend, indemnify, and hold harmless EirePeak Pathways and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of our service, by you or any person using your account and password; b) a breach of these Terms, or c) your participation in any EirePeak Pathways program.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
